The Investment Advisers Act of 1940 defines an investment adviser using a three-part test, sometimes called the “ABC test.” A person is an investment adviser if they (a) provide advice about securities, (b) are in the business of doing so, and (c) receive compensation for it.
All three prongs must be met. A neighbor offering an opinion at a barbecue isn't an adviser — they're not in the business and they're not paid. A magazine publisher writing about markets in print isn't an adviser either, because the advice is impersonal and the publication is not the business of advising (the Lowe v. SEC case settled this in 1985).
